Membership Terms & Conditions & Regulations Agreement

This Membership Agreement (“Agreement”) outlines the terms, conditions, and regulations governing the use of Smash Yard Pickleball Park (“Smash Yard,” “the Park,” “we,” or “us”). By signing below or completing an online transaction, you (“Member”) agree to comply with the policies stated herein.

1. Membership Requirements

• All members must provide accurate personal information at the time of sign-up.
• Memberships are non-transferable and may be used only by the individual named on the account.
• Members must check in upon arrival and present valid identification if requested.

2. Membership Billing & Payments

• Members agree to pay all fees associated with their chosen membership or pass.
• Smash Yard reserves the right to adjust rates with advance notice.
• Declined or failed payments must be resolved before further facility use.
• Refunds are issued only in accordance with the Refund & Cancellation Policy.

3. Court Booking Requirements

• Courts must be booked in advance, either online or through our front desk.
• Members must honor their booking time and vacate the court promptly at the end of their session.
• Repeated no-shows or late arrivals may result in booking restrictions.

4. Code of Conduct

• Treat staff and fellow players with respect and courtesy.
• Maintain good sportsmanship at all times.
• Refrain from disruptive, aggressive, or unsafe behaviour.
• Follow all instructions provided by Smash Yard staff.

Violations may result in temporary or permanent suspension without refund.

5. Facility Use & Safety

• Children under 12 must be supervised by a parent/guardian at all times.
• Members must wear proper athletic attire and non-marking footwear.
• Smash Yard is not responsible for injuries resulting from misuse of equipment or failure to follow safety guidelines.
• Park access may be restricted for events, classes, or maintenance.

6. Equipment Use

• Members may use personal paddles and balls or rent equipment at the Park.
• Rented equipment must be returned in good condition.
• Damaged or unsafe equipment must be reported immediately.

7. Photography & Videography

Photography & Videography:

• Photography and videography are not permitted inside bathroom areas.
• Personal devices must be kept secure; do not leave them unattended on courts or lounge equipment.

Respect for Privacy:

• Consent must be obtained from anyone who may appear in a photo or video.
• If someone is captured unintentionally, the image or video must be deleted upon request.
• Commercial or promotional recording requires written approval.

8. Personal Belongings

• Smash Yard is not responsible for lost, stolen, or damaged belongings.
• Members are encouraged to store personal items securely and keep valuables with them.

9. Health & Wellness

• Members should be in reasonable physical health to participate.
• If feeling unwell, members should refrain from using the Park until fully recovered.
• Any accidents, incidents, or injuries must be reported to staff immediately.

10. Membership Freeze & Cancellation

• Freezes and cancellations must follow Smash Yard’s official Membership Policy.
• Auto-pay (monthly subscription) memberships are not eligible for freezes.
• Fixed-term plans (12 weeks or more) may qualify for freezes under specific conditions.
• Cancellations require proper notice as outlined in the policy.

11. Termination of Membership

Smash Yard may suspend or terminate membership for:

• Rule violations
• Harassment or misconduct
• Safety concerns
• Non-payment

No refunds will be issued for violations of this Agreement.

12. Liability Waiver

By signing this Agreement, you acknowledge and accept the inherent risks associated with participating in sports and recreational activity.

You agree that Smash Yard, its owners, staff, contractors, and representatives are not liable for injuries, accidents, or damages arising from:

• Use of courts or equipment
• Participation in games or activities
• Negligence on the part of the Member
• Loss or damage to personal property

Members assume full responsibility for their participation.

13. Video Surveillance & Security Monitoring

For security purposes, Smash Yard Pickleball Park uses video surveillance equipment to monitor and protect the Park on a 24-hour basis. By signing this Agreement, you acknowledge and agree that by accessing the pickleball courts, outdoor lounge areas, spectator zones, and other open-air Park spaces, you will be subject to video surveillance and recording, and you permit Smash Yard Pickleball Park to store this footage in any manner it deems necessary, for any duration it deems necessary.

Video surveillance is limited to shared and open areas only and does not include the interior of bathrooms or any private changing areas.

You consent to being photographed and/or recorded by Smash Yard Pickleball Park for security, safety, incident review, and operational purposes.

14. Agreement to Terms

By signing this form or completing an online purchase, you confirm that:

• You have read and understood this Agreement.
• You agree to abide by all Smash Yard policies, rules, and regulations.
• You acknowledge that policies may be updated periodically and published accordingly.
